1.Conditions of Sale :

Alaya Holidays cannot be held responsible for bad weather conditions, flight cancellations, strikes, demonstrations, political incidents, threats of war or any other exceptional and unpredictable major event, that is to say, consequences of events outside our control. Tour itinerary or duration alterations, due to an unpredictable  event  out of the control of Alaya Holidays, cannot be reimbursed or compensated by Alaya Holidays. The ensuing additional costs (hotels, flights, taxes, transportation etc) will be paid by the travellers. It is therefore important that all travellers have an insurance which covers any cancellation, modification or repatriation caused by events out of our control. Same for customers who would like to fly by plane or helicopter from the Everest, Annapurna region or anywhere in the country, Alaya Holidays will not be responsible for the unfortunate turn that this flight may take and asks its customers to ensure that they are well covered by their insurance before booking this flight. It is therefore the traveller's responsibility to have insurance covering the costs of the helicopter in the event of a search AND rescue, whatever the content and the destinations planned for the trip with Alaya Holidays.

Alaya Holidays will not, in any way, be held responsible in the case of personal loss, sickness, injury either slight or severe, or for death during the trip.

Alaya Holidays holds the right to modify the tour and itinerary also to use other means of transportation in the case of break down, sickness or any other major event when it is judged necessary or reasonable to protect the safety of the clients. All extra expenses such as extra hotel or lodge fees, flights or additional costs of transport will be payable by the client and settled on the spot.

If the customer makes additions outside the itinerary that he has accepted and which has been sold to him (additional hike, detour or visit in addition), Alaya Holidays will have to invoice the customer these modifications (right of entry on a site, rental of a vehicle with driver to go there and guided tour by the local professional guide already planned on the itinerary of the customer if it is available and according to the hours already worked during his day).

Throughout the trip the client must agree to accept every decision taken by the guide, who has been allotted by Alaya Holidays, whatever this decision may be. The managing director of Alaya Holidays or the allotted guide can, during the tour, modify reservations for an equivalent service, or cancel a trip or a day of a trip for safety reasons.

These conditions cannot be modified except by special written permission from the managing director of Alaya Holidays agency, Mr Raj Singh Thapa.

In the case of dispute, the contract between the two parties (the client and Alaya Holidays) will be under the jurisdiction of Kathmandu according to the Nepalese.
